TERMS & CONDITIONS FOR PURCHASE OF CMR NASHVILLE AND/OR HOTDISC
PROMOTIONS PACKAGES WITH SERVICES PROVIDED BY DJANGO PROMOTIONS

These promotional packages are offered by AirPlay Direct, acting as the authorized seller of services provided by Django Promotions. With the purchase of any promotional package (also referred to herein as the "Agreement"), Purchaser and Django Promotions (hereinafter referred to as "the parties") mutually agrees to the acceptance of the Terms and Conditions contained herein.

Purchaser (hereinafter referred to as "you") hereby warrants that: (i) you are at least 18 years of age (whether an individual, representing yourself, or if applicable, acting as legal representative for a band, group, company or other legal entity, or (ii), If you are under the age of 18, then a parent or guardian must take responsibility for payment and legal disclosure.

You hereby warrant that you have all legal rights to, and/or authorized permission from the owner, and/or necessary licenses, to offer Rights Holder Content to Django Promotions under this Agreement. "Rights Holder Content" means any particular sound recordings (herein referred to as "tracks") and underlying musical compositions that Rights Holder will make available to Django Promotions in association with any promotion offered herein, for the non-exclusive physical or digital delivery of said sound recordings to broadcasters in accordance with this Agreement. Any sound recordings, and the underlying musical compositions that are provided by, or on behalf of, Rights Holder to Django Promotions, must be owned or controlled by Rights Holder and/or have been cleared by Rights Holder.

Upon purchase of any CMR Nashville promotion package referenced herein, you will be required to send, via e-mail, a broadcast quality 320 kbps MP3 file of your sound recording(s), 300 dpi hi-resolution jpeg graphic images your album sleeve, and promo shots, along with all credits, to include writers, publishers, record label (if applicable), album title, record number and designated website. All files and required information regarding your release shall be e-mailed to Lee Williams at djangoproms@btinternet.com. No promotion package shall begin until all necessary files are delivered by you.

In the case of a CMR Nashville "Deluxe Album" promotion package where an artist interview has been agreed to, Django Promotions will arrange for a suitable time for a telephone interview with you, or they will arrange a personal interview with you in Nashville, if scheduling accommodates this.
All purchases are final. There is no refund policy. All monies shall be paid in U.S. Dollars. The order must be paid for in full at the point-of-purchase. No credit terms are available.

Please Read Before Purchasing:
Hotdisc Packages are Subject to Availability

Depending on the time of the month an order is placed, and due to a limited number of slots on the Hotdisc Rush Released CD compilation each month, neither a Premier Slot (tracks 1-6), or a Non-Premier Slot, shall be guaranteed until purchaser receives notification from Django Promotions, within 24 hours of your purchase, confirming your inclusion in the forthcoming month, or in the month following the forthcoming month. To avoid this possible delay of services, please contact Lee Williams at djangoproms@btinternet.com to check availability in advance. However, no slots shall be reserved, or guaranteed, until you have completed the purchase transaction of the Hotdisc package.

The 14th day of the month is usually the cut-off point for the forthcoming issue of Hotdisc. However, you may check up until the 25th of the month on the availability of a slot. Premier slots are sold first, but there may be Non-Premier slots still available up until this time.

Once you have been guaranteed a slot on Hotdisc, you will be required to send, via e-mail, an MP3 file of your sound recording (320kbs), a hi-res photo graphic of the album sleeve, a selection of promo shots (300 dpi jpgs), along with credits to include writers, publishers, label, album title, record number and website. All files and required information regarding your release shall be e-mailed to Lee Williams at djangoproms@btinternet.com.

In the case of a CMR/Hotdisc "Diamond Package" or a where an artist interview has been agreed to, Django Promotions will arrange a suitable time with you for a telephone interview, or they will arrange a personal interview in Nashville, if scheduling accommodates this.
You will receive 2 free copies of the Hotdisc CD which includes the particular song, as well as feedback from Django Promotions about how your track is doing in terms of airplay and reaction.
The Hotdisc Rush Released sleeve features full writer and publishing details, direct contacts of all acts, and timings with intro and ending information for DJs making it extremely user-friendly. We also provide DJs with a complete A-Z of every track on every Rush Release CD to help them locate music from past editions.
It is understood and agreed to by the parties that AirPlay Direct acts hereunder as the seller for services provided by Django Promotions, and assumes no liability hereunder. The parties agree to indemnify and hold AirPlay Direct harmless in any and all actions, demands, claims, and liabilities, including but not limited to, damages to reputation and attorney's fees incurred in the enforcement of the provisions of this Agreement, which might be suffered by such injured party as a result of any act, omission, breach of misrepresentation committed or made by either party with respect to the other.
With your purchase of any CMR Nashville and/or Hotdisc promotion package(s), you hereby accept the Terms and Conditions as stated herein, in addition to any applicable AirPlay Direct "Terms of Use" as described here
